Terms & Conditions
These terms govern your use of services provided by Rigup (sole trader Rigup Tradies, ABN 99 852 418 021), operating from Ocean Shores NSW Australia ("Rigup", "we", "us"). By signing up via rigup.com.au, paying for the Build, or using the Lead Engine subscription, you ("you", "the customer") agree to these terms.
1. Definitions
- Build — the one-time $999 (AUD inclusive) website + Google Business Profile setup service.
- Lead Engine — the $299 (AUD inclusive) per month recurring subscription that runs and improves your lead-gen system.
- Go Live — the date your website is published to your domain, your Google Business Profile is verified, your tracked phone and SMS numbers are provisioned, and Rigup confirms all 8 acceptance criteria are met.
- Measurable lead — a non-spam inbound contact about a quote, booking, or service, captured through Rigup-provisioned infrastructure: a form submission on your Rigup-built site, a call to your tracked phone number, or an SMS to your tracked SMS number.
- Calendar month from Go Live — the calendar month in which Go Live occurs, then each subsequent calendar month.
2. Services we provide
2.1 Build (one-time, $999)
The Build delivers a custom website on a domain registered in your business name, a claimed and configured Google Business Profile, lead-capture forms, a tracked phone number, a tracked SMS number, analytics installation, and a 15-minute walkthrough call.
The Build is delivered within 14 calendar days of payment (the "Build SLA"), subject to clock-pause rules in §3.
The Build fee is paid at signup. It is Afterpay-eligible (4 instalments of $249.75). The Build fee is non-refundable once we have commenced delivery (typically within 24 hours of payment), because the Build represents delivered work.
2.2 Lead Engine ($299/mo from Go Live)
The Lead Engine subscription includes:
- Hosting, SSL, domain renewal, email forwarding, uptime monitoring, daily backups
- Google Business Profile management (up to 4 posts/month, photo updates, Q&A monitoring, review responses)
- Local SEO (citations, schema markup, suburb landing pages)
- Up to 4 SEO-targeted content posts per month, AI-drafted and human-reviewed
- Lead-capture forms with AI auto-responder (SMS + email reply within 60 seconds, 24/7)
- Review request automation (post-job SMS to your customers)
- Google Ads management (PMax + Search campaigns, weekly tuning, search-term mining, ad copy refreshes)
- Up to 200 outbound SMS per month
- Monthly performance report (calls, form fills, GBP impressions, top queries, MoM trends)
- Email and SMS support during business hours (9am–5pm AEST/AEDT, Mon–Fri)
The Lead Engine subscription is created in Stripe at signup but billing does not commence until Go Live. From Go Live onwards, $299/mo bills monthly on the Go Live anniversary.
3. The 14-day Build SLA
The Build SLA is 14 active calendar days. The clock pauses if:
- You take more than 72 hours to complete the intake form (Days 0–3)
- You take more than 72 hours to provide feedback during a revision round (Days 6–9 and 9–11)
Customer-side delays do not count against us but extend your Go Live date. The maximum Build duration including pauses is 21 calendar days. If we miss the 14-active-day target through our own delay, you receive your first month of Lead Engine free.
The Build includes 2 rounds of revisions. A "round" means a single consolidated list of changes per draft.
4. The 5-leads guarantee
For every calendar month from Go Live where the count of measurable leads is fewer than 5, that month's $299 Lead Engine fee is automatically refunded to your card via the Stripe API within 5 business days of month-end. Service continues uninterrupted.
4.1 Guarantee conditions
The 5-leads guarantee applies only if:
- You are running Google Ads at a minimum of $500/mo spend, paid direct to Google in your own Google Ads account
- You have provided complete intake information so we can build the site correctly
- Your Google Business Profile is not suspended or restricted due to your action
- You are responsive to customer enquiries we route to you (we cannot guarantee leads if customers can't reach you)
4.2 What is not covered by the refund
- The Build fee ($999) is never refunded
- Months where you ran Google Ads below the $500/mo minimum spend
- Months where your GBP was suspended due to your action (e.g. fake business address, prohibited content)
- Months where you did not provide complete intake information
- Spam leads, fake leads, leads from competitors stress-testing the site (excluded from count, audited per dispute)
4.3 Day 90 review
If we have refunded 3 consecutive months by Day 90 from Go Live, we will proactively initiate a diagnostic call to identify the root cause. If your market structurally cannot support 5 measurable leads per month, we will mutually part ways. The Build (site, content, domain, GBP) remains yours.
5. No lock-in
You can cancel the Lead Engine subscription at any time, with no fees, no notice period, and no exit hoops, by:
- Replying with the word "cancel" to any email from us, OR
- Cancelling via the Stripe Customer Portal, OR
- Emailing billing@rigup.com.au
On cancellation:
- The current month of service continues until the end of the billing period
- No further billing
- If month-end audit shows under-5 leads, that month's refund still processes
- Your domain transfers to you (or stays with you, if it was already registered to your business)
- Your content (copy, photos, schema) is exported and delivered as HTML + Markdown
- Google Business Profile ownership returns fully to you
- We forward emails to your nominated address for 30 days while you switch over
- After 30 days, your tenant data is archived for 90 days then permanently deleted
6. Customer obligations
You agree to:
- Provide accurate intake information within 3 calendar days of signup
- Respond to revision drafts within 72 hours during build
- Operate Google Ads at a minimum of $500/mo if you wish the 5-leads guarantee to apply
- Not use Rigup-provided infrastructure for unlawful purposes, spam, or content prohibited by Google's, Stripe's, or our hosting providers' policies
- Hold valid trade licences and insurance applicable to your services in your jurisdiction
- Pay invoices on time; we may pause services after 7 days of non-payment per §10
7. Intellectual property
What you own: your domain (registered to your business name), your custom site copy, your photos and any imagery you supply, your customer data, your Google Business Profile, your Google Ads account.
What we own: our build templates, design system, automation tooling, AI agent pipelines, internal documentation. These are licensed to you for use on your own site only; you do not have rights to redistribute, sub-licence, or replicate the underlying tooling.
8. Service availability
We target 99.9% uptime for your site. In the event of an outage longer than 1 hour caused by Rigup-provided infrastructure (excluding upstream provider outages, DNS issues outside our control, or your own actions), that calendar month's Lead Engine fee is reduced to $0.
We are not liable for losses arising from outages, including but not limited to lost leads, lost revenue, or reputational harm.
9. Limitation of liability
To the maximum extent permitted by Australian law:
- Our total liability to you for any claim arising from or in connection with these terms is limited to the total fees you paid us in the 12 months prior to the claim
- We are not liable for indirect, consequential, special, or incidental losses including lost profits, lost leads, lost revenue, business interruption, or loss of goodwill
- Nothing in these terms excludes liability that cannot be excluded under the Australian Consumer Law
10. Late payment and suspension
If a payment fails:
- Day 1: friendly automated reminder
- Day 7: site shows "Site temporarily paused" page (DNS continues to resolve)
- Day 14: site is offline pending resolution
- Day 30: subscription cancelled, off-boarding triggered
You can revive any time within 30 days by paying outstanding amounts.
11. Privacy and data protection
How we collect, use, store, and share your data is governed by our Privacy Policy, which forms part of these terms.
12. Termination by Rigup
We may suspend or terminate your services with notice if:
- You materially breach these terms and fail to remedy within 14 days of written notice
- We determine your business cannot reasonably benefit from our services (e.g. service area too small to support 5 leads/month) and after Day 90 review we mutually agree to part ways
- Your conduct exposes Rigup to legal, reputational, or regulatory risk
On termination by us, you keep your Build deliverables (site, content, domain, GBP). Refunds for unused subscription days are pro-rated and processed within 5 business days.
13. Governing law and disputes
These terms are governed by the laws of New South Wales, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of New South Wales.
Before commencing any legal action, the parties agree to attempt to resolve disputes in good faith via direct discussion within 30 days of either party giving written notice of the dispute.
14. Changes to these terms
We may update these terms from time to time. Material changes will be notified to you by email at least 30 days before they take effect. Your continued use of services after the effective date constitutes acceptance of the updated terms. If you do not agree, you may cancel under §5.
